Terms of Engagement

1.      Introduction

Deluxe Models Australia Pty Ltd ABN 150 327 567 (DMA, We or Us) introduces models to customers for the purpose of the models being engaged by the customers in their function.

DMA has executed a service agreement with the customers setting out the terms of engagement of the models in the function.

This document serves as an agreement between the model and DMA and advises the model of the rules that apply to the customer’s engagement.

 

2.      Acceptance of this Agreement

You do not have to sign this agreement physically to agree to its terms.  If you proceed with the engagement and attend the function of the customer, you will be deemed to have accepted these terms and conditions that apply to your engagement.

 

3.      Who is doing what and your rights?

(a)        The terms of engagement apply to every function that you attend if the booking is done through DMA.

(b)        You will be required to perform the duties as agreed with you which may include poker dealer, waitress or game host.  These duties are performed topless.

(c)        Unless it is agreed upfront, the customer cannot ask you to perform and equally you must not perform any other duties at the function.

(d)        Importantly,

(i)         you need to ascertain whether the premises, their access and regress are safe.  In case of doubt, please contact us;

(ii)        the customer is obligated to ensure that you are protected from harm and are treated with respect;

(iii)       You must be paid in full before the start of the function.  If the customer does not pay you in full, you are entitled to walk away from the functions.

(e)       There is a strictly “No Touching Policy”.  This policy means that under no circumstances any person in the function can initiate physical contact with you, harass or intimidate you.

(f)        You must not engage privately with the customer or any attendees of the functions.

(g)        The customer was advised and agreed that the models are there to perform their duties and no more.  Under no circumstances this engagement is in relation to any sexual activity or erotica.

(h)        The engagement with respect to the function is solely between you and the customer and not between you and DMA.

(i)         If the terms of this agreement are breached by the customer or any patron who attended the function, invited or uninvited, you are entitled to terminate your duties and leave the functions immediately.

(j)         You must be at the function at least 10 minutes before the designated start time of your duties.  This is in order to enable you to prepare and be ready to commence your duties as undertaken with the customer.

(k)        You must advise DMA if you are unable to attend or are running late to a function so we can locate an alternative model.  We will advise you if there is a change to the function.

(l)         If you are running late to a function;

(i)         you must provide DMA an estimated time of arrival to the function so that DMA can advise the customer;

(ii)        the customer may demand that we provide an alternative model to the function.  If that occurs, we will advise you as soon as we are aware that an alternative model is provided and we will not be liable to you for any costs;

(iii)       and your engagement is for a set number of hours, you will be required to complete the set number of hours from the time you arrived at the function.

 

4.      What do we do?

(a)        Your engagement is directly by the customer to perform the duties as agreed and any financial or other obligation must be discharged between you and the customer on the night.  If you are required by law to issue the customer with an invoice, please do so.  You are responsible for your own tax liability (personal or business).

(b)        DMA is an intermediary agency that connects the models with the customer.  DMA does not have any employment or principal and agent relationship with you or the customer.  If you require insurance with respect to your duties, please arrange that independently to DMA.  You are an independent contractor of DMA.

(c)        The customer shall be solely responsible and liable for the function and whatever happens in the function.  DMA has no control over the activities in the function and the manner the function is run.  You expressly release DMA from any liability in relation to the function and your duties in the function.

 

5.      Your privacy  and security

(a)        The customer is aware and has agreed that your details must be kept a secret.

(b)        You should adopt an alias or a stage name for the function and never give your name, personal details or telephone number to the customer or any one at the function.

(c)        DMA will never publish your photo online unless you agreed to it and will not give the customer your personal information.

(d)        You should not share any information about the function, DMA or your payment with any other model or agency.

(e)        You must not stay at the function after your official duties are completed even if you are invited by the customer or any guests.

(f)        If you suspect something is wrong, please contact us or leave the function immediately.

(g)        You should contact DMA by phone or SMS to advise that the function has finished.  If we do not hear from you, we will try to contact you and failing that, we will contact the customer.  These measurements are for your safety and we encourage you to adhere by them.
